Phoenix's Cannabis Regulations: The Rules That Matter

By CityRuleLookup Editorial Team

Every city handles cannabis regulations a little differently. In Phoenix, Arizona, there are 7 distinct rules that residents and property owners should be aware of. Some are stricter than what neighboring cities enforce, and others are more relaxed. Here is what you need to know.

Social Equity Licensing

Arizona Proposition 207 (2020) legalized adult recreational cannabis and created a social equity ownership program. Phoenix permits licensed dispensaries to operate under the state's Marijuana Establishment licensing framework administered by ADHS.

Key details: State law: Arizona Proposition 207 (2020). Equity licenses: 26 social equity licenses. Adult age: 21 years and older. Regulator: Arizona Department of Health Services. Sales started: January 22, 2021.

Operating a cannabis establishment without a state license or required city zoning clearance is unlawful. Violations may trigger ADHS license revocation, criminal charges under ARS Title 36, and Phoenix zoning enforcement actions including civil penalties and closure orders.

Buffer Zones

Arizona Revised Statutes §36-2806 require licensed cannabis dispensaries to maintain a 1320-foot separation from existing public or private K-12 schools. Phoenix enforces these state buffers through its zoning approval process for marijuana establishments.

Key details: School buffer: 1,320 feet from K-12 schools. State statute: ARS §36-2806. Measurement: Property line to property line. Residential zones: Dispensaries prohibited. Verifier: ADHS plus Phoenix Planning.

Dispensaries operating inside the 1,320-foot school buffer face license denial or revocation by ADHS, plus zoning enforcement by Phoenix including stop-work orders, certificate-of-occupancy revocation, and civil fines for ongoing operation in a noncompliant location.

This is one of the stricter rules in Phoenix's municipal code. If you are unsure whether your situation complies, it is worth checking with the city before proceeding.

Cannabis Delivery Rules

Arizona authorized licensed cannabis delivery to adult consumers under Proposition 207 and ADHS rulemaking effective 2024. Phoenix follows state delivery rules; only licensed marijuana establishments may deliver, and deliveries must go to private residences.

Key details: Authority: ARS §36-2854 plus A.A.C. R9-18. Customer age: 21 and older verified. Delivery agent: Licensed dispensary employee. Implementation: Phased starting 2024. Prohibited locations: Schools and public property.

Unlicensed delivery, deliveries to minors, or transporting cannabis in unauthorized vehicles can result in ADHS license revocation, criminal charges, and forfeiture. Phoenix may issue traffic, parking, or zoning citations for related municipal violations.

Personal Cultivation Limits

Under Arizona Proposition 207 adults 21 and older may cultivate up to six cannabis plants per person, capped at twelve plants per household. Plants must be grown in an enclosed, locked area not visible from public view in Phoenix.

Key details: Per adult limit: 6 plants. Household cap: 12 plants total. Location: Inside primary residence only. Visibility: Not visible from public. Statute: ARS §36-2852.

Exceeding plant counts, growing in view of public spaces, or cultivating outside a primary residence can result in seizure, civil penalties, and possible criminal charges under ARS Title 36. Landlords may prohibit cultivation in lease agreements; violations risk eviction.

Commercial Cannabis Zoning

Phoenix Zoning Ordinance Chapter 36 governs where licensed marijuana establishments may operate. Dispensaries are limited to specific commercial and industrial districts, require Use Permit review, and must meet separation, parking, and operational standards.

Key details: Code chapter: Phoenix Chapter 36 zoning. Allowed districts: C-2, C-3, A-1, A-2 districts. Approval: Use Permit required. School buffer: 1,320 feet state minimum. Reviewer: Planning and Development Department.

Operating a cannabis facility in a noncompliant zone, without a Use Permit, or in violation of operational conditions can trigger zoning enforcement, civil penalties, certificate-of-occupancy revocation, and coordinated state license review by ADHS.

This is not one of those rules that cities tend to ignore. Phoenix actively enforces its commercial cannabis zoning requirements.

Home Cultivation

Under Arizona's Smart and Safe Act (ARS §36-2852), adults 21+ may cultivate up to 6 marijuana plants per person at their primary residence, with a maximum of 12 plants per household if two or more adults reside there. Plants must be in an enclosed, locked area not visible from public view. Phoenix does not impose additional local restrictions.

Key details: State Law: ARS §36-2852 (Smart and Safe Act). Plant Limit: 6 per person, 12 per household max. Location: Primary residence only. Security: Enclosed, locked area required. Visibility: Not visible from public view.

Exceeding plant limits: warning, then fines $100 to $500. Visible grows: citation. Growing for unlicensed sale: criminal charges.

Dispensary Zoning

Phoenix zoning requires dispensaries to be at least 1,320 feet from schools, parks, community centers, and places of worship, and 500 feet from residentially zoned districts. Cultivation facilities must be 5,280 feet from similar facilities and 1,000 feet from residential zones. A use permit under Section 307 is required.

Key details: School/Park Buffer: 1,320 ft minimum. Residential Buffer: 500 ft from residential zones. Cultivation Separation: 5,280 ft from same use type. Cultivation Residential: 1,000 ft from residential zones. Use Permit: Required per Section 307.

Operating without license: closure and fines $5,000+. Buffer violations: permit revocation. Sales to minors: criminal charges and license forfeiture.

This is not one of those rules that cities tend to ignore. Phoenix actively enforces its dispensary zoning requirements.

If you are a homeowner, renter, or business owner in Phoenix, take the time to understand these requirements before they become a problem.
