Brookfield's Fence Regulations: The Rules That Matter
Every city handles fence regulations a little differently. In Brookfield, Wisconsin, there are 2 distinct rules that residents and property owners should be aware of. Some are stricter than what neighboring cities enforce, and others are more relaxed. Here is what you need to know.
Height Limits
The City of Brookfield has unusually restrictive fence rules under Chapter 17 (Zoning) of the Municipal Code. Privacy fences are generally prohibited around the perimeter of a yard. Only a decorative fence that is at least 50% open and 4 feet or less in height (picket, wrought iron, or split rail) may enclose a yard. A solid privacy fence is allowed only as a 20-foot maximum length, 6-foot maximum height segment adjacent to a patio in the rear yard. Chain link fencing is permitted only for a small pet enclosure (max 100 sq ft, 6 ft high, in rear yard, 20 ft from lot line) or a children's activity enclosure (max 500 sq ft, 6 ft high). A fence permit is required (currently $80, plus a $50 minor plan review fee).
Key details: Perimeter Yard Fence: Decorative only, >=50% open, <=4 ft. Privacy Fence: 20 ft long x 6 ft high max, rear yard adjacent to patio. Chain Link (Pets): 100 sq ft max, 6 ft high, rear yard, 20 ft from lot line. Chain Link (Children): 500 sq ft max, 6 ft high. Decorative Fence Materials: Picket, wrought iron, split rail.
Installing a fence without the required permit, exceeding the 4-foot height for a perimeter decorative fence, building a privacy fence longer than 20 feet or taller than 6 feet, placing a privacy fence outside the rear yard or away from a patio, or using chain link outside of the narrow pet/children's enclosure exceptions can result in stop-work orders, citation, municipal forfeitures under Chapter 17, and an order to remove or modify the fence. Failure to call Diggers Hotline (811 / 800-242-8511) at least three days before excavation is a separate state-law violation. Unresolved violations are referred to Waukesha County Circuit Court.
Compared to other cities, Brookfield takes a harder line on height limits. The enforcement and penalty structure reflects that.
Neighbor Fence Rules
WI Stat. Β§90.02 to 90.14 provides line fence cost-sharing for rural/agricultural land. Urban residential fences: each owner responsible for their own.
Key details: Rural: Cost-sharing statute (Β§90.02). Urban: Each owner responsible. Disputes: Town supervisor (rural). Written Agreement: Recommended.
Civil dispute for cost-sharing in urban areas. Rural: town supervisor adjudication per Β§90.02. Property line encroachments: survey and civil remedy.
The Bottom Line
Brookfield's fence regulations rules are a mixed bag. Some areas are strict, others are relaxed, and the details matter. The best approach is to check the specific rule that applies to your situation rather than assuming Brookfield is broadly strict or permissive.
Keep in mind that Brookfield can amend these rules at any council meeting. For the most current version of any rule mentioned here, check the specific ordinance page, where we track updates as they happen.
