Carmichael's Fence Regulations: The Rules That Matter

By CityRuleLookup Editorial Team

Every city handles fence regulations a little differently. In Carmichael, California, there are 4 distinct rules that residents and property owners should be aware of. Some are stricter than what neighboring cities enforce, and others are more relaxed. Here is what you need to know.

Height Limits

Sacramento County Zoning Code §5.2.5 governs Carmichael fence heights: front yard in RD zones - 3 ft solid, 4 ft chain-link, or 7 ft open ornamental. Side and rear yard - up to 7 ft without a permit. Over 7 ft requires a building permit.

Key details: Code Section: Sacramento County Zoning §5.2.5. Front Yard Solid: 3 ft max. Front Yard Chain Link: 4 ft max. Front Yard Open Ornamental: 7 ft max. Side/Rear Yard: 7 ft, no permit.

Fence height violations are processed by Sacramento County Code Enforcement under SCC Ch. 16.18 administrative penalty schedule - $100 first, $200 second, $500 third+. Continued non-compliance can trigger an abatement order requiring removal at the owner's expense.

Retaining Walls

Retaining walls in Carmichael require a Sacramento County Building Permit under SCC §16.04 when they retain more than 4 feet of soil measured from the bottom of the footing to the top of the wall, or when they support a surcharge (driveway, structure, slope).

Key details: Permit Exempt: <= 4 ft retained, no surcharge. Permit Required: > 4 ft or any surcharge. Engineering Required: >= 4 ft / surcharged.

Building without a required permit: stop-work order plus double permit fees on the after-the-fact permit. Engineered wall failures causing slope failure can carry civil and criminal exposure under CA Bus & Prof Code §6735 (engineering practice without license).

Permit Requirements

Fences 7 feet tall or less in Carmichael do not require a building permit when sited per Sacramento County Zoning §5.2.5. Fences over 7 feet, retaining walls over 4 feet, or masonry walls over 6 feet require a Sacramento County Building Permit under SCC Title 16.

Key details: Permit Exempt: Fences <= 7 ft. Permit Required: > 7 ft, masonry > 6 ft, retaining > 4 ft. Building Permits: 916-875-5296.

Building without a required permit: stop-work order under SCC §16.04 and double permit fees on after-the-fact permit. Continued construction or refusal to abate: misdemeanor under SCC §1.01.190 - up to $1,000 fine and/or six months.

Pool Barriers

Pool barriers in Carmichael must be at least 60 inches high with no openings allowing passage of a 4-inch sphere, self-closing/self-latching gates with latches 60 inches above grade, and at least two of the seven CA Pool Safety Act drowning prevention features. Required by CRC §R326 / CA H&SC §115920.

Key details: Barrier Height: 60 inches minimum. Sphere Test: No 4-inch opening. Gate Latch Height: 60 inches above grade. Gate Swing: Away from pool. Safety Features Required: 2 of 7 (CA H&SC §115922).

Building permit cannot be finaled until barrier is verified compliant. Non-compliant barriers on existing pools: code enforcement order with $100/$200/$500 administrative escalation. Drowning death from non-compliant barrier: civil liability under CA H&SC §115928 plus negligence per se.

This is one of the stricter rules in Carmichael's municipal code. If you are unsure whether your situation complies, it is worth checking with the city before proceeding.

The Bottom Line

Carmichael's fence regulations rules are a mixed bag. Some areas are strict, others are relaxed, and the details matter. The best approach is to check the specific rule that applies to your situation rather than assuming Carmichael is broadly strict or permissive.

Keep in mind that Carmichael can amend these rules at any council meeting. For the most current version of any rule mentioned here, check the specific ordinance page, where we track updates as they happen.
