How Spring Hill Handles Fence Regulations: A Practical Guide

By CityRuleLookup Editorial Team

Spring Hill maintains 106 local ordinances across all categories, and 8 of those deal specifically with fence regulations. Here is a breakdown of what the city actually requires, what is prohibited, and where Spring Hill falls on the strict-to-permissive spectrum compared to other cities.

Neighbor Fence Rules

Hernando County does NOT have a municipal good-neighbor or cost-sharing fence ordinance. Spring Hill is a platted suburb with mostly quarter-acre lots, so boundary-fence disputes are common and are handled as private civil matters under Florida law - the County does not adjudicate property-line disputes. Florida has no general residential cost-sharing statute (FS Chapter 588 covers agricultural/livestock fencing only). A fence built on a neighbor's land is an encroachment resolved in Hernando County Court. Sunshine 811 (1-800-432-4770) must be called before digging fence posts, per Florida Statute Chapter 556.

Key details: Cost-Sharing Statute: None - private civil matter (FS Ch. 588 covers agriculture only). Finished-Side Rule: Not codified in Hernando County (HOAs may impose one). Property Surveys: Owner's responsibility - Florida-licensed surveyor. Encroachment Resolution: Hernando County Court, 20 N. Main St., Brooksville. Code Enforcement Role: Enforces Sec. 10-55/10-56 only, NOT property lines.

A fence over the property line is a civil encroachment, not a code violation - resolution is through Hernando County Court (20 N. Main Street, Brooksville). Damaging an underground utility line because Sunshine 811 was not called is a violation of FS 556.105 and exposes the digger to personal liability for repair costs. A fence that violates Section 10-55 height, openness, or vision-triangle rules can be cited by Hernando County Code Enforcement regardless of which neighbor built it. HOA covenant violations are enforced privately by the HOA, not the County.

Approved Materials

Hernando County Code Section 10-55 allows fences in Spring Hill to be constructed of any 'acceptable and durable materials customarily used or marketed for fencing.' In practice this means wood (pressure-treated, cedar), vinyl/PVC, chain link, aluminum, wrought iron, and decorative masonry. Materials must be new or in new condition; posts must be resistant to decay, corrosion, or termite infestation. Front-yard fences (and rear-yard fences adjacent to waterfront, golf courses, or common areas) must be at least 25% open - chain link, split-rail, picket, or similar - so solid wood, solid vinyl, and solid masonry are restricted to side/rear yards away from those features.

Key details: Material Standard: Acceptable, durable, customarily used or marketed for fencing (Sec. 10-55). Allowed in Practice: Wood, vinyl/PVC, chain link, aluminum, wrought iron, masonry. Posts: Resistant to decay, corrosion, or termite infestation. Condition: New or in new condition. Front-Yard Material Limit: Must be at least 25% open (no solid wood/vinyl/masonry).

Using non-customary or non-durable materials (raw plywood, tarps, plastic snow fence as permanent fencing), used or weathered salvage in poor condition, or non-rot-resistant posts violates Section 10-55. A solid wood, solid vinyl, or solid masonry fence in a residential front yard or adjacent to a waterfront/golf course/common area violates the 25% openness requirement. Code Enforcement may require correction.

Permit Requirements

Effective July 31, 2024, Hernando County Ordinance 2024-07 amended Code Section 10-54 to remove the building-permit requirement for residential walls and fences UNDER 7 feet in height. Fences and walls 7 feet or taller still require a permit. The Hernando County Board of County Commissioners voted unanimously to rescind the lower-height permit requirement, with the policy goal that local rules should not exceed the Florida Building Code. Spring Hill residents pull any required permit from the Hernando County Building Division at 789 Providence Blvd., Brooksville, FL 34601, (352) 754-4050.

Key details: Permit Threshold: 7 feet (under 7 ft = no permit; 7 ft or taller = permit) per Ord. 2024-07. Effective Date: July 31, 2024. Issuing Office: Hernando County Building Division, 789 Providence Blvd., Brooksville. Phone: (352) 754-4050. Online Portal: hernandocountyfl-energovweb.tylerhost.net.

Installing a fence or wall 7 feet or taller without a Hernando County building permit is a violation of Section 10-54. Building any height fence that violates Section 10-55 standards (height limits, vision triangle, materials, corner-lot setback) is a violation regardless of whether a permit was required. A pool barrier installed without the underlying pool permit cannot be approved at final inspection. Code Enforcement (789 Providence Blvd., 352-754-4056) may issue citations and require corrective action.

The rules around permit requirements in Spring Hill lean permissive, but that does not mean anything goes.

Height Limits

Spring Hill is an unincorporated CDP in Hernando County and is governed by Hernando County Code of Ordinances Chapter 10, Article III (Fence Code). Section 10-55 caps fences and walls in front yards within any residential district at 4 feet, and in side and rear yards at 8 feet. Fences in rear yards adjacent to waterfront areas, golf courses, common areas, or similar open spaces are limited to 4 feet AND must be at least 25% open (chain link, split-rail, picket, or similar). On corner lots, the secondary yard must maintain a 9-foot setback for fences over 4 feet in height that exceed 75% opacity.

Key details: Residential Front-Yard Max: 4 feet (Hernando Code Sec. 10-55). Residential Side/Rear Max: 8 feet. Waterfront / Golf Course Rear-Yard Max: 4 feet AND at least 25% open. Front-Yard Construction: Chain link, split-rail, picket, or similar; at least 25% open. Corner Lot Secondary Yard Setback: 9 ft setback for fences over 4 ft AND over 75% opaque.

Fences exceeding 4 feet in a residential front yard, exceeding 8 feet in a residential side or rear yard, exceeding 4 feet adjacent to a waterfront/golf course/common area, or violating the 9-foot corner-lot setback are violations of Section 10-55. A solid fence over 2 feet inside the clear-sight triangle of a driveway or street intersection is also a violation. Hernando County Code Enforcement (789 Providence Blvd., Brooksville, FL 34601, 352-754-4056) may issue a notice of violation and require the fence to be lowered, relocated, or removed.

Fence Requirements

Hernando County Code Section 10-55 requires fence and wall construction in Spring Hill to be 'of acceptable and durable materials customarily used or marketed for fencing,' with materials either new or in new condition. Posts must be resistant to decay, corrosion, or termite infestation. All installation must be performed with good workmanship. Front-yard fences must be at least 25% open (chain link, split-rail, picket, or similar). The 2024 amendment (Ord. 2024-07) removed the permit requirement for fences under 7 feet, but all Section 10-55 standards and Section 10-56 prohibitions continue to apply. The 8th Edition (2023) Florida Building Code Section 1609 wind-load standards apply (Hernando is in the ~140 mph Vult zone per ASCE 7-22).

Key details: Material Standard: Acceptable, durable, customarily used or marketed for fencing (Sec. 10-55). Material Condition: New or in new condition. Posts: Resistant to decay, corrosion, or termite infestation. Workmanship: Good workmanship required. Front-Yard Openness: At least 25% open (chain link, split-rail, picket, similar).

Fences using non-durable or non-customary materials (raw plywood, plastic tarps, etc.), posts that are not rot-resistant, or fences with poor workmanship may be cited under Section 10-55. Front-yard or open-space fences under 25% openness, fences over 2 feet inside a clear-sight triangle, and fences violating the 9-foot corner-lot setback are violations regardless of the permit-exempt status. Hitting a buried utility because Sunshine 811 was not called exposes the owner to liability under FS 556.105.

Retaining Walls

Hernando County Code Section 10-55 treats walls and fences together, so the same height limits (4 ft front, 8 ft side/rear, 4 ft adjacent to waterfront/golf course/common area) apply. Decorative landscape walls are governed by Chapter 10 Article III. Structural retaining walls supporting earth pressure are also regulated under the 8th Edition (2023) Florida Building Code, Chapter 18 (Soils and Foundations), and a Hernando County building permit is required when the wall exceeds 4 feet measured from the bottom of the footing to the top of the wall, OR for any height that supports a surcharge (slope, driveway, structure). Spring Hill is generally flat, but some lots near the Weeki Wachee headwaters and along Spring Hill Drive have grade changes that trigger engineering.

Key details: Wall Height Limits (Same as Fence): 4 ft front, 8 ft side/rear, 4 ft adjacent to waterfront/golf/common (Hernando Sec. 10-55). Structural Permit Threshold: Over 4 ft (footing to top) OR any height with surcharge (FBC Ch. 18). Engineer Seal: Required for engineered walls (Florida-registered P.E.). Issuing Office: Hernando County Building Division, 789 Providence Blvd., (352) 754-4050. Adopted Code: 8th Edition (2023) Florida Building Code, Building Chapter 18.

Building a structural retaining wall over 4 feet (footing-to-top) without a Hernando County building permit, or building any height of wall supporting a surcharge without engineered drawings, violates the 8th Edition (2023) FBC and Section 10-54. A decorative wall over 4 ft in the front yard or 8 ft in the side/rear yard violates Section 10-55 regardless of structural review. Code Enforcement (789 Providence Blvd., 352-754-4056) may require removal or modification.

Pool Barriers

Pool barriers in Spring Hill (unincorporated Hernando County) must comply with Florida Statute Chapter 515 (Residential Swimming Pool Safety Act) and the 8th Edition (2023) Florida Building Code Residential Section R4501.17. Required minimums: 48-inch barrier height on the side facing away from the pool, no openings that allow passage of a 4-inch-diameter sphere, maximum 2-inch ground clearance, self-closing and self-latching gates that open outward away from the pool, and latch release at least 54 inches above the bottom of the gate. The barrier is reviewed as part of the pool permit by the Hernando County Building Division at 789 Providence Blvd., Brooksville.

Key details: Governing Law: FS Ch. 515 + FBC Residential R4501.17 (8th Edition / 2023). Minimum Barrier Height: 48 inches above grade on outside face. Max Opening: Less than 4-inch sphere. Bottom Clearance: Max 2 inches above grade (exterior). Gate Operation: Self-closing, self-latching, opens outward away from pool.

Operating or filling a pool, hot tub, or spa without a compliant barrier (or one of the alternative FS 515.27 safety features) is a SECOND-DEGREE MISDEMEANOR under FS 515.27(2). The penalty is waivable if the owner corrects the violation and completes a state-approved drowning-prevention education program within 45 days. Hernando County Building Division will not approve the pool final inspection until the barrier passes; Code Enforcement (789 Providence Blvd., 352-754-4056) may issue citations.

Compared to other cities, Spring Hill takes a harder line on pool barriers. The enforcement and penalty structure reflects that.

Material Restrictions

Hernando County Code Section 10-56 (Prohibitions) prohibits electric fences, barbed wire fences, and razor wire fences in unincorporated Hernando County (including Spring Hill). It also prohibits fences and walls containing hazardous materials, broken glass, spikes, nails, barbs, or any materials that can inflict pain or injury to any person or animal. The 2024 fence-permit amendment (Ord. 2024-07) did not change these prohibitions - they apply to every fence in Spring Hill regardless of whether a permit was required. Front-yard fences must also be at least 25% open per Section 10-55, which functionally excludes solid wood and solid masonry from the residential front yard.

Key details: Electric Fence: Prohibited (Hernando Code Sec. 10-56). Barbed Wire: Prohibited in residential Spring Hill. Razor Wire: Prohibited. Hazardous Materials: Prohibited. Broken Glass / Spikes / Nails / Barbs: Prohibited on any fence or wall.

Installing barbed wire, razor wire, or an electrified fence in Spring Hill violates Section 10-56 and may be cited regardless of fence height or whether a permit was pulled. Attaching broken glass, steel spikes, or sharp nails to the top of a fence or wall is prohibited. A solid front-yard fence (no openness) violates Section 10-55 even though materials may be otherwise acceptable. Code Enforcement (789 Providence Blvd., 352-754-4056) may issue citations and require removal. HOA covenant violations are enforced privately by the HOA.

This is not one of those rules that cities tend to ignore. Spring Hill actively enforces its material restrictions requirements.

The Bottom Line

Spring Hill is tougher than many cities when it comes to fence regulations. Out of the 8 rules covered here, 2 are rated strict. If you are a homeowner, renter, or business owner in Spring Hill, take the time to understand these requirements before they become a problem. Most violations come with fines, and some repeat violations can escalate.
