Short-Term Rentals in Madison, AL: What Residents Actually Need to Know

By CityRuleLookup Editorial Team

If you live in Madison or are thinking about moving there, short-term rentals are one of those things you probably won't think about until they affect you directly. Madison has 10 specific rules on the books covering different aspects of short-term rentals, and some of them might surprise you.

Permit Requirements

Madison's proposed STR ordinance (No. 2026-201) requires every operator to obtain a Short-Term Rental Operational Permit plus a business license for each unit before renting. Until adopted, the city grants no STR permits and business-license applications for STRs are being denied.

Key details: Status: Proposed (Ord. 2026-201), pending. STR permit: Required per unit. Business license: Also required. Existing operators: Apply within 90 days. Reviewing depts: Building, Planning, Fire, Revenue.

Operating without the required permit is unlawful; each day is a separate offense subject to notice of violation, municipal-court citation, fine and/or imprisonment, plus permit revocation.

Taxes & Fees

Alabama levies a state transient occupancy (lodgings) tax of 5% in Madison County, which is part of the Mountain Lakes region, on stays under 180 continuous days. Madison also has a city lodging tax (Code Ch. 10, Art. VIII), and STR operators pay a business-license tax under the city code.

Key details: State lodgings tax: 5% (Madison County). Statute: Ala. Code 40-26-1. Exemption: 180+ continuous days. City lodging tax: Code Ch. 10, Art. VIII. Permit fee (proposed): $350 nonrefundable.

The proposed ordinance requires the property to have no outstanding taxes; unpaid lodging taxes or license taxes can block permit issuance and lead to enforcement by the Revenue Department.

Parking Rules

The proposed ordinance requires one off-street parking space per bedroom at each STR, subject to on-site availability. Guests must park in the designated parking areas, and overnight street parking by transients is strictly prohibited.

Key details: Off-street spaces: One per bedroom. Guest parking: Designated areas only. Street parking: Overnight prohibited. Application proof: Parking survey required. Subject to: On-site availability.

Overnight street parking by guests violates the ordinance and can count toward the three substantiated complaints in 12 months that trigger a permit suspension of at least six months.

Registration Rules

The proposed ordinance requires an application to the Building Department for the STR permit and to the Revenue Department for a business license, with a nonrefundable $350 application fee. Applicants must submit a deed/lease, ID, parking survey, floorplan, insurance certificate, and neighbor list.

Key details: Application fee: $350 nonrefundable (proposed). Files with: Building + Revenue departments. Permit term: Annual. Renewal: 30 days before expiration. Annual inspection: Required before issuance.

Fraud, misrepresentation, or a false statement in the application is grounds for revoking the permit and/or business license after notice and hearing.

Occupancy Limits

Under the proposed ordinance, no STR may exceed the maximum guest occupancy set by the Building Inspector or Fire Marshal. Only rooms meeting the bedroom definition may be used as guestrooms, and guests per bedroom are determined using adopted building and fire codes.

Key details: Max occupancy set by: Building Inspector / Fire Marshal. Guestrooms: Bedrooms meeting IBC only. Events: Parties/weddings prohibited. Conflict rule: More stringent code applies. Neighbor notice: Must state max renters.

Exceeding the approved occupancy or hosting a prohibited event is a violation; three substantiated complaints in 12 months triggers at least a 6-month permit suspension.

Noise Rules

The proposed STR ordinance has no separate decibel limit but bans events and requires a 24/7 local contact who must respond within 30 minutes to any disturbance. STRs must also comply with Madison's general noise ordinance; three substantiated complaints in 12 months suspend the permit.

Key details: STR decibel limit: None; general code applies. Events: Prohibited. Local contact: 24/7, respond in 30 min. Complaint trigger: 3 in 12 months = suspension. State backstop: Ala. Code 13A-11-7.

A disturbance or breach of the peace is grounds for enforcement; three valid complaints substantiated by the city or police within 12 months suspend the STR permit for at least six months.

Primary-Residence-Only Rule

Madison's proposed ordinance does not require an STR to be the host's primary residence. Instead it caps citywide STR permits at 190 (0.75% of housing stock), allows various dwelling types, and restricts STRs to zoning districts approved in the Zoning Ordinance.

Key details: Primary residence required: No. Permit cap: 190 citywide (0.75%). Eligible dwellings: Single/multi-family, ADUs. RVs as STR: Prohibited. Location: Permitted zoning districts only.

Operating in a non-permitted zoning district or beyond the permit cap is unlawful and enforceable by citation, fine, or injunction as a public nuisance per se.

Host Presence Rule

Madison's proposed ordinance does not require the host to be present, but every STR must designate a Local Contact Person at least 21 years old with authority to manage the property, available 24/7 and required to respond on-site within 30 minutes of a complaint.

Key details: Host presence: Not required. Local contact: Required, age 21+. Availability: 24/7. Response time: On-site within 30 minutes. Number allowed: One at a time.

Failure of the Local Contact Person to comply is deemed noncompliance by the owner and can lead to citation, fine, and permit suspension or revocation.

Insurance Requirements

Madison's proposed ordinance requires a certificate of insurance with at least $1,000,000 in liability and personal-injury coverage, via either a homeowner's-policy rider expressly covering STRs or a commercial STR policy, submitted with the permit application.

Key details: Minimum coverage: $1,000,000 liability. Option A: Homeowner's rider covering STRs. Option B: Commercial STR policy. Cancellation notice: 30 days to city. When required: At application and renewal.

Lack of qualifying insurance blocks permit issuance; a lapse or misrepresentation of coverage is grounds for suspension or revocation of the STR permit after notice and hearing.

Night Caps

Madison's proposed ordinance sets no annual night cap on how many nights an STR may rent. Its main quantity control is a citywide cap of 190 STR permits (0.75% of housing supply), issued first-come, first-served, and permits are annual.

Key details: Annual night cap: None. Permit cap: 190 citywide (0.75%). Allocation: First-come, first-served. Permit term: Annual. Cap adjustable: By City Council yearly.

Operating without a permit once the 190-permit cap is reached is unlawful; enforcement includes citations, fines, and abatement of the STR as a public nuisance per se.

The Bottom Line

Madison's short-term rentals rules are a mixed bag. Some areas are strict, others are relaxed, and the details matter. The best approach is to check the specific rule that applies to your situation rather than assuming Madison is broadly strict or permissive.

Keep in mind that Madison can amend these rules at any council meeting. For the most current version of any rule mentioned here, check the specific ordinance page, where we track updates as they happen.
