How Boise Handles Single-Use Items: A Practical Guide

By CityRuleLookup Editorial Team

If you live in Boise or are thinking about moving there, single-use items are one of those things you probably won't think about until they affect you directly. Boise has 4 specific rules on the books covering different aspects of single-use items, and some of them might surprise you.

Polystyrene Foam Rules

Boise cannot ban polystyrene (Styrofoam) foam takeout containers. Idaho Code 39-7405 expressly preempts cities from regulating auxiliary containers, including expanded polystyrene cups, plates, and clamshells.

Key details: Preemption: Idaho Code 39-7405. Foam coverage: Expressly preempted. Recycling: Not curbside. City option: Voluntary only.

No municipal enforcement possible — the city cannot prohibit or fine foam container use under state preemption.

If you are coming from a city with tighter rules, you will find Boise gives residents more flexibility on polystyrene foam rules.

Plastic Straw Rules

Boise has no straws-on-request rule and cannot enact one. Idaho Code 39-7405 preempts city regulation of auxiliary containers including straws, so plastic straws are freely available at Boise restaurants.

Key details: Status: No regulation. Preemption: Idaho Code 39-7405. Default: Provided automatically. Voluntary swap: Allowed.

No city violation available — local straw rules are unenforceable under Idaho Code 39-7405.

The rules around plastic straw rules in Boise lean permissive, but that does not mean anything goes.

Utensils-On-Request

Boise cannot require restaurants to provide single-use utensils only by request. Idaho Code 39-7405 preempts cities from regulating auxiliary containers and accessories including disposable forks, knives, spoons, and condiment packets.

Key details: Status: No mandate. Preemption: Idaho Code 39-7405. Default: Auto-included. Opt-out: Customer / platform.

No municipal violation available; the city has no authority to require opt-in distribution under state preemption.

If you are coming from a city with tighter rules, you will find Boise gives residents more flexibility on utensils-on-request.

Plastic Bag Rules

Boise cannot enforce a plastic bag ban or fee. Idaho Code § 67-2340 provides that 'any regulation regarding the use, disposition or sale of...any imposition of any prohibition, restriction, fee imposition or taxation of auxiliary containers...shall be imposed only by statute enacted by the legislature.' The preemption was enacted in 2016 (H.B. 372).

Key details: Local Ordinance: None — Idaho preempts. Preemption Statute: Idaho Code § 67-2340 (2016). Original Bill: H.B. 372 (Otter, March 24, 2016). Carve-Out: Curbside recycling programs preserved. Innovation: Hefty ReNew orange-bag program for film.

Boise cannot fine retailers or shoppers for bag distribution. Bag-related litter is enforceable through Boise City Code Title 5 (Garbage and Solid Waste) and Idaho Code § 18-7031 (littering, infraction up to $500). The 2021 Hefty ReNew orange-bag program — operated by Republic Services in partnership with the City — accepts plastic film and is the most direct way for Boise residents to keep bags out of the landfill.

Boise is more permissive than most cities when it comes to plastic bag rules. That said, there are still limits.

The Bottom Line

Compared to many U.S. cities, Boise gives residents more room on single-use items. 4 of the 4 rules here are rated permissive. But permissive does not mean unregulated. There are still requirements, and the city does enforce them when violations are reported.

All of the above reflects Boise's municipal code as of our last review. If you need specifics on fines, exemptions, or filing requirements, the detailed ordinance pages linked above have the full breakdown.
