Houston's Solar Energy: The Rules That Matter
Every city handles solar energy a little differently. In Houston, Texas, there are 3 distinct rules that residents and property owners should be aware of. Some are stricter than what neighboring cities enforce, and others are more relaxed. Here is what you need to know.
Expedited Solar Permitting
Houston Public Works offers Solar Express expedited permitting for residential rooftop PV systems under 25 kW. Compliant applications receive same-day or next-business-day approval via online submission.
Key details: System Cap: 25 kW residential threshold. Turnaround: Same-day or next business day. Submission: Online via ePermits. Designation: SolSmart program participant. Inspection: Within 5 business days.
Installations without permits trigger stop-work orders, double permit fees, and may void manufacturer warranties or utility net-meter interconnection agreements with CenterPoint Energy.
The rules around expedited solar permitting in Houston lean permissive, but that does not mean anything goes.
Panel Permits
Houston requires local building permits for residential and commercial solar panel installations. Permits involve submitting solar array plans for structural, electrical, and building code review. Texas requires installers to hold a Texas Electrical Contractor's License (TECL).
Key details: Permits Required: Building, electrical, and potentially structural. Permit Cost: $50-$500 typical range. Processing Time: 2-4 weeks. Installer License: Texas Electrical Contractor's License (TECL) required. Property Tax: Solar exempt from property tax increase.
Installing solar panels without required permits can result in failed inspections, required removal, and fines. Unlicensed electrical work is a violation of state licensing requirements.
HOA Restrictions
Texas Property Code Sec. 202.010 prohibits HOAs from banning solar energy devices. HOAs may impose limited aesthetic restrictions but cannot effectively prevent installation. HB 431 (2025) expanded protection to explicitly include solar roof tiles.
Key details: State Protection: Texas Property Code Sec. 202.010. HB 362 (2011): Original solar rights law. HB 431 (2025): Added solar roof tiles to protection. HOA Approval: Required but cannot be unreasonably withheld. Performance Test: Restrictions cannot reduce output by >10%.
HOAs that attempt to ban solar installations violate Texas Property Code Sec. 202.010. Homeowners can challenge unlawful restrictions through legal action.
Houston is more permissive than most cities when it comes to hoa restrictions. That said, there are still limits.
The Bottom Line
Compared to many U.S. cities, Houston gives residents more room on solar energy. 2 of the 3 rules here are rated permissive. But permissive does not mean unregulated. There are still requirements, and the city does enforce them when violations are reported.
These rules come from Houston's publicly available municipal code. For complete penalty schedules, exemption details, and answers to common questions, see the individual ordinance pages throughout this guide.
