How Phoenix Handles Tobacco & Vaping: A Practical Guide

By CityRuleLookup Editorial Team

Phoenix maintains 251 local ordinances across all categories, and 3 of those deal specifically with tobacco & vaping. Here is a breakdown of what the city actually requires, what is prohibited, and where Phoenix falls on the strict-to-permissive spectrum compared to other cities.

Tobacco Age Restrictions

Federal Tobacco 21 (Public Law 116-94) and Arizona Senate Bill 1009 (ARS section 36-798.03) bar Phoenix retailers from selling cigarettes, cigars, vapes, or any tobacco product to anyone under twenty-one. Photo ID is mandatory for buyers appearing under twenty-seven.

Key details: Federal age: 21, since December 2019. AZ statute: ARS section 36-798.03. ID check trigger: Buyer appearing under 27. City rule: Phoenix Code 39-3.

Selling tobacco or vapes to a person under twenty-one is a class three misdemeanor under ARS section 36-798.03 and Phoenix City Code section 39-9, plus civil penalties and possible city license suspension on repeat offenses.

This is one of the stricter rules in Phoenix's municipal code. If you are unsure whether your situation complies, it is worth checking with the city before proceeding.

Flavored Tobacco Bans

Phoenix has no local flavored tobacco or vape ban. A.R.S. Section 36-798.08 declares the sale and marketing of tobacco, alternative nicotine, and vapor products to be a matter of statewide concern and preempts local regulation. Arizona itself has banned the retail sale of flavored vapor products other than tobacco and menthol statewide.

Key details: Local Flavor Ban: None - state preempted. State Preemption Statute: A.R.S. Section 36-798.08. State Flavor Restriction: Arizona: vapor products limited to tobacco/menthol. Federal Flavor Rule: FDA: cartridge e-cigs limited to tobacco/menthol. Enforcement Agency: Arizona DLLC; Arizona Attorney General; FDA.

Because A.R.S. Section 36-798.08 preempts local flavor regulation, no City of Phoenix citation can be issued for selling flavored tobacco or vape products beyond what state and federal law restrict. The Arizona flavor restriction is enforced by the Arizona Department of Liquor Licenses and Control and the Arizona Attorney General, and federal flavor rules are enforced by the U.S. Food and Drug Administration.

Phoenix is more permissive than most cities when it comes to flavored tobacco bans. That said, there are still limits.

Vape Retail Rules

Phoenix cannot enforce its own tobacco or vape retailer licensing rules. A.R.S. Section 36-798.08 declares the sale and marketing of tobacco products, alternative nicotine products, and vapor products to be a matter of statewide concern and preempts inconsistent city, town, or county regulation. Retail licensing is handled by the Arizona Department of Liquor Licenses and Control (DLLC).

Key details: Local Tobacco/Vape License: None - state preempted. State Preemption Statute: A.R.S. Section 36-798.08. State Retail License: Arizona DLLC Tobacco Retail License (effective Jan 1, 2023). Minimum Sales Age: 21 statewide (federal Tobacco 21 + A.R.S.). Enforcement Agency: Arizona DLLC; Arizona Attorney General.

Because A.R.S. Section 36-798.08 preempts local regulation of tobacco and vapor product sales and marketing, no City of Phoenix citation can be issued for operating a tobacco or vape retailer without a city license, since no such license exists or can lawfully exist. Retailer licensing, underage sales (under 21), and product compliance are handled by the Arizona Department of Liquor Licenses and Control (DLLC) and the Arizona Attorney General, with federal flavor and authorization rules enforced by the U.S. Food and Drug Administration.

The rules around vape retail rules in Phoenix lean permissive, but that does not mean anything goes.

The Bottom Line

Compared to many U.S. cities, Phoenix gives residents more room on tobacco & vaping. 2 of the 3 rules here are rated permissive. But permissive does not mean unregulated. There are still requirements, and the city does enforce them when violations are reported.

Keep in mind that Phoenix can amend these rules at any council meeting. For the most current version of any rule mentioned here, check the specific ordinance page, where we track updates as they happen.
