Grand Prairie, TX Business Licensing & Operations: Tobacco Retail License (2026)

Chapter 13, Article VIII (Smoking), Secs. 13-137 through 13-139, sets Grand Prairie's retail-conduct rules for tobacco and e-cigarette sales; the city creates no standalone business license for these retailers, since Texas's own tobacco retail permit is issued through the Comptroller's office. Sec. 13-137(a) makes it unlawful for a business owner, manager or employee in control of the premises to place a tobacco or electronic smoking device vending machine anywhere accessible to someone under 21. Subsections (b) and (c) create a criminal-negligence offense for a retailer, or its agent or employee, selling or giving a tobacco product or e-cigarette to anyone under 21, or to someone who intends to pass it to a minor, and hold the retailer liable if it failed to adequately supervise or train staff.

It's a defense under (d)-(e) if the buyer presented a valid, government-issued photo ID, such as a driver's license, passport or military ID, consistent with their appearance and showing they're 21 or older. Sec. 13-137(f) bars self-service, direct-access displays of tobacco or vapor products unless the business excludes everyone under 21 at all times, and (g) requires an ID check for any buyer who appears under 30. Retailers must adequately supervise and train employees to prevent violations under (h). Separately, Sec. 13-139 bars anyone under 18 from any business whose primary line is selling, distributing or allowing on-site use of electronic smoking devices, including vapor lounges, bars, salons and stores, and requires those businesses to post entrance signage saying so.

Enforcement runs through Sec. 13-140's right of entry and search warrant authority, and Sec. 13-141 sets fines up to $2,000 per violation per day, plus possible suspension or revocation of a retailer's permit or certificate of occupancy after notice and a hearing before a city-manager-appointed hearing officer.
