Florida Statute 569.003 requires retailers selling cigarettes or tobacco products to obtain a permit from the Division of Alcoholic Beverages and Tobacco. Vape shops are licensed under the Nicotine Products Act (FL Β§877.111). Miami-Dade Chapter 17B regulates cigarette and vape sales, and Chapter 8A requires a Local Business Tax Receipt. State law preempts local flavor bans (FL Β§877.111). Retailers must verify ID for purchasers under 30, post warning signs, and keep tobacco behind the counter. Self-service displays are prohibited.
Sales to minors trigger state license suspension and fines up to $500 per offense. Operating without a state permit or county business tax receipt is a misdemeanor.
