Section 84.34 of the San Bernardino County Development Code declares all commercial cannabis activity in unincorporated territory a per se public nuisance, including cultivation greater than six personal plants, manufacturing, distribution, testing, microbusiness operations, and storefront or non-storefront retail. The ban covers Joshua Tree, Lucerne Valley, Phelan, Wrightwood, Big Bear City, and other unincorporated communities. State licenses do not override the local ban. Property owners face nuisance abatement, water and electricity service disconnection in egregious cases, and lien recovery for cleanup costs in desert grow operations.
Unlicensed grows or warehouses can be abated immediately with fines up to 1000 dollars per day per violation and water service termination through Mojave Water Agency coordination.
