Cannabis cultivation is completely illegal in Idaho. Idaho is one of the few states with no medical or recreational cannabis program. Growing any amount of marijuana, including for personal use, is a criminal offense under Idaho Code Title 37, Chapter 27 (Uniform Controlled Substances Act). Boise enforces state law prohibiting all cannabis cultivation.
Idaho classifies marijuana as a Schedule I controlled substance with no exceptions for medical use or home cultivation. Possession of any amount is a misdemeanor for first offenses. Growing marijuana plants constitutes manufacturing a controlled substance, which is a felony under Idaho Code Β§37-2732. Even a single plant can result in felony charges. CBD products containing any detectable THC are also illegal. Idaho voters have not passed any cannabis legalization measures, and the state constitution was amended in 2022 to make legalization more difficult.
Manufacturing (growing) marijuana is a felony punishable by up to 5 years in prison and a $15,000 fine for fewer than 25 plants. Possession of 3 ounces or less is a misdemeanor with up to 1 year in jail and a $1,000 fine. Subsequent offenses carry enhanced penalties. Drug paraphernalia possession is a separate misdemeanor offense.
