AS 17.38.020 makes it lawful for adults 21+ to possess, grow, process, or transport up to six marijuana plants, with no more than three mature flowering at one time. A household with multiple adults is capped at twelve plants regardless of occupants. Plants must be kept in a place not visible from a public area, and cultivation must occur on property owned or lawfully occupied by the cultivator with the property owner's consent. While municipalities under AS 17.38.110 may regulate or ban commercial operations, the personal home-grow right is established by statute statewide and cannot be eliminated by local ordinance.
Exceeding plant limits or visible cultivation is a violation under AS 17.38.040; penalties range from civil fines for small overages to misdemeanor charges for unlawful manufacture.
