Highland Park, IL Cannabis Regulations: Home Cultivation (2026)

Illinois's Cannabis Regulation and Tax Act (410 ILCS 705) legalized adult-use cannabis but did NOT authorize recreational home cultivation. Only registered medical cannabis patients under the Compassionate Use of Medical Cannabis Program (410 ILCS 130) may grow up to 5 plants at home, provided the plants are kept in a locked, enclosed space not visible from public areas (410 ILCS 705/10-5). Non-patients cultivating any amount face criminal penalties under 720 ILCS 550 (Cannabis Control Act) — 5 plants or fewer is a civil violation with a $200 fine; more than 5 plants is a felony. Lake County municipalities including Waukegan, Libertyville, Gurnee, Highland Park, and Lake Forest cannot authorize recreational home grows because state law preempts. Landlords may prohibit growing in rental properties under 410 ILCS 705/10-35. Patient cultivation must be disclosed to the Illinois Department of Public Health. Growing for unlicensed sale remains a felony regardless of patient status. The Illinois State Police and Lake County Sheriff investigate unauthorized grow operations, especially those generating odor complaints or suspicious electrical use.
