Levittown, PA Cannabis Regulations: Home Cultivation (2026)

Pennsylvania does not permit home cultivation of cannabis by medical patients or recreational users. The PA Medical Marijuana Act (Act 16 of 2016, codified at 35 P.S. §10231.101 et seq.) legalized medical marijuana only for purchase from state-licensed dispensaries — it specifically does NOT authorize patients or caregivers to grow their own plants, unlike laws in neighboring New Jersey, New York (adult-use), and 20+ other states. This makes PA's medical program one of the more restrictive in the country regarding home cultivation. Any cannabis cultivation in Bucks County remains a violation of the PA Controlled Substance, Drug, Device and Cosmetic Act (35 P.S. §780-113(a)(30)) — a felony for any quantity of cultivation. Penalties scale with plant count: small cultivation (under 30 grams of processed flower equivalent or small plant counts) is often charged as possession with intent to distribute but may be eligible for probation; larger grows are charged as manufacturing with potential 5-10+ year sentences. Bucks County District Attorney's office actively prosecutes cultivation cases. Federal law (21 USC §841) also prohibits all cultivation as cannabis remains a Schedule I controlled substance. Reclassification proposals at the federal level as of 2024-2025 have not changed this. Adult-use (recreational) legalization has been debated in the PA General Assembly multiple sessions but has not passed as of 2025. The only legal cannabis cultivation in PA occurs at licensed state-approved grower/processor facilities (the nearest to Bucks operate in other counties). Possession for personal use (under 30 grams flower, under 8 grams concentrate) remains a summary offense in most of PA but is decriminalized in several municipalities — Bucks County has not adopted any decriminalization ordinance.
