ORC 3780.29 permits an adult twenty-one or older to cultivate, in a secure space at their primary residence, up to six marijuana plants, with a maximum of twelve plants per household regardless of how many adults reside there. Cultivation must occur out of public view, in a locked area, and only the cultivating adults may access the grow area. Plants and harvested marijuana must be limited and stored to prevent access by minors. ORC 3780.30 prohibits sale of home-cultivated marijuana, while ORC 3780.32 allows landlords to prohibit cultivation in leased premises.
Exceeding plant limits, growing in public view, or distributing home-grown marijuana can result in misdemeanor or felony charges under ORC 2925.04 and forfeiture of plants. Local zoning cannot prohibit lawful home cultivation that meets state requirements.
