Monmouth County, NJ Cannabis Regulations: Home Cultivation (2026)

New Jersey prohibits home cannabis cultivation for both recreational and medical users — a significant exception to the adult-use legalization passed under CREAMMA (N.J.S.A. 24:6I-31 et seq.) in 2021. Recreational cannabis users 21+ may legally possess up to 6 ounces of flower purchased from licensed dispensaries and consume privately, but cultivation of any amount remains a criminal offense. First-offense home cultivation is a 3rd-degree crime (3 to 5 years imprisonment and up to $25,000 fine) for 5 to 10 plants; growing more than 10 plants is a 2nd-degree crime (5 to 10 years). Medical cannabis patients under the Compassionate Use Medical Marijuana Act (N.J.S.A. 24:6I-1 et seq., 2010) similarly cannot home-grow — they must purchase from licensed alternative treatment centers. Legalization advocacy (NJ CAN 2020, now Cannabis Industry Association) continues to push for home grow reform; several bills have been introduced but not enacted as of 2026. Landlords and HOAs can separately prohibit cannabis-related activity even where legal. Federal Controlled Substances Act prohibits cultivation regardless of state law. Monmouth County law enforcement treats illegal grows as felony-level cases, particularly if quantity suggests distribution intent.
