Alabama prohibits all home cultivation of cannabis statewide. Even patients enrolled in the medical cannabis program cannot grow plants at home; only licensed cultivators authorized by the Alabama Medical Cannabis Commission may produce cannabis lawfully.
Under the Darren Wesley 'Ato' Hall Compassion Act (Code §20-2A-1 et seq.) and Alabama's controlled substances laws (§13A-12-211 et seq.), cannabis cultivation by individuals remains a felony. The Alabama Medical Cannabis Commission (AMCC) issues a limited number of cultivator licenses; no home-grow option exists for patients or caregivers. Possession or cultivation of any number of plants outside of a licensed facility is unlawful. Local governments cannot decriminalize personal cultivation, as Alabama Code preempts contrary municipal ordinances. Possessing cannabis seeds or paraphernalia for cultivation also remains prohibited statewide.
Home cultivation is a Class C felony with imprisonment of one year and one day to ten years and substantial fines.
