Mississippi's Medical Cannabis Act, enacted in 2022 under MS Code Β§41-137-1 through Β§41-137-65, does not authorize home cultivation by medical patients. All cannabis must be cultivated at state-licensed facilities regulated by the Mississippi Department of Health (MSDH) Medical Cannabis Program and tracked through seed-to-sale systems. Registered patients may only purchase from licensed dispensaries. Recreational cannabis remains entirely illegal in Mississippi with no personal cultivation allowance. Jackson County enforces state law through the Sheriff's Department and prosecutes unauthorized cultivation as a felony under MS Β§41-29-139. Growing 30 or more plants or possessing over 1 kilogram triggers enhanced trafficking penalties under MS Β§41-29-139(f) with potential 10-30 year prison sentences. Federal law continues to classify cannabis as Schedule I regardless of state medical status.
