Home cultivation became legally operative 18 months after the first adult-use retail dispensary opened, which occurred statewide in late 2023. Landlord can restrict cultivation in lease. Nassau County and its municipalities cannot ban home cultivation (state preemption under Cannabis Law 131). Smoking cannabis is permitted anywhere tobacco smoking is permitted, except in vehicles and workplaces. Odor from cultivation is not a statutory nuisance but can still be cited under general nuisance codes.
