Oklahoma's medical marijuana program under 63 O.S. Β§420 (State Question 788, 2018) allows patients with OMMA-issued cards to cultivate up to 6 mature plants and 6 seedlings at their primary residence. Unlicensed cultivation remains a state felony under 63 O.S. Β§2-401 punishable by 2 years to life for commercial quantities, and misdemeanor possession for small amounts. Oklahoma County does not impose additional cultivation restrictions beyond state law. Plants must be grown in an enclosed, locked space not visible from public streets or adjacent properties. Minors cannot have access to cultivation areas. Landlords may prohibit cultivation in rental properties under 63 O.S. Β§427.8. HOAs can restrict outdoor cultivation. Patients can designate a caregiver to grow on their behalf. The 12-plant limit (6 mature + 6 seedling) applies per patient household, not per cardholder β two cardholders in one home still limited to 12 plants total. Odor must not create a nuisance. Electrical modifications for grow lights require permits under OKC Β§155-40.
