Home cultivation of cannabis is prohibited throughout DeSoto County. Mississippi's Medical Cannabis Act (Miss. Code §41-137) does NOT authorize patient home grows — only licensed cultivators may produce cannabis in Mississippi.
Mississippi's Medical Cannabis Act, codified at Miss. Code §41-137-1 et seq., legalizes medical cannabis for qualifying patients but does not authorize personal or caregiver home cultivation under any circumstance. All medical cannabis in Mississippi must be grown by Mississippi Department of Revenue (MDOR) and Mississippi State Department of Health (MSDH) licensed micro-cultivators or cultivators. Any growing of cannabis at a private residence in DeSoto County — by a registered patient, caregiver, or otherwise — is a criminal offense under Miss. Code §41-29-139. Recreational cultivation remains a felony. DeSoto County, Southaven, Olive Branch, Horn Lake, and Hernando all enforce the state prohibition; none have enacted (or could enact) permissive home-grow rules.
Cultivation of any amount: felony under Miss. Code §41-29-139. Under 30 grams equivalent: may be charged as misdemeanor possession plus manufacturing. Distribution or sale of homegrown: felony with prison sentence. No medical-card defense for home growing.
