Virginia legalized recreational cannabis possession and limited home cultivation in 2021. Adults 21+ may grow up to 4 plants per household for personal use. Plants must not be visible from public spaces and must be tagged with the grower's information.
Under Virginia Code §4.1-1101.1, adults 21 and older may cultivate up to 4 marijuana plants per household (not per person). Plants must be grown in a secure location not visible from public areas. Each plant must be tagged with the grower's name, driver's license number, and a notation that the plant is for personal use only. Only one harvest at a time may be possessed. Commercial sale remains illegal as retail sales have not yet been authorized. Virginia Beach does not impose additional local restrictions beyond state law on home cultivation.
Growing more than 4 plants is a civil penalty of $250 for the fifth plant and increases with more plants. Growing with intent to distribute is a felony. Untagged plants may result in civil penalties.
