Austin FAQ
Can I rent both my main house and my Austin ADU without living there?
Yes. Since HOME Phase 1 took effect in December 2023, Austin no longer requires owner occupancy of either unit. An absentee owner can lease the principal dwelling and the ADU to separate long-term tenants.
I have an older ADU permit with a deed restriction - what now?
Pre-HOME permits often recorded a deed restriction requiring owner occupancy. The restriction stays on title until the owner applies to Development Services for a release. While the recorded restriction is on file, both units cannot be rented to non-owners without breaching the deed restriction.
