The city retains authority over generally applicable zoning, fire safety, parking, and right-of-way use. Cape Coral FAQ

Where can food trucks operate in Cape Coral?

Food trucks may operate in commercial and mixed-use zones, at special events, on private commercial property with owner permission, and in designated food truck areas. Residential areas are generally restricted.

Can I set up a food truck in a Cape Coral park?

Operating a food truck in a city park requires approval from the Parks and Recreation Department. Contact the department for permit requirements and approved locations.

Fort Myers FAQ

Can Fort Myers stop a food truck from parking near a restaurant?

No. Florida Statute § 509.102 (HB 1193 of 2020) preempts local regulation of food-truck licenses, fees, and operations, and prohibits any municipality from banning food trucks 'within the entirety of the entity's jurisdiction.' That has been read to prohibit Fort Myers from adopting proximity buffers requiring food trucks to stay a certain distance from brick-and-mortar restaurants. The city can still enforce generally applicable parking, ROW, fire, and zoning rules that apply equally to all vehicles or businesses.

Where can a food truck legally park in Fort Myers?

On private property with the landowner's written permission, in compliance with the property's underlying zoning. To park on a city street, sidewalk, or other public right-of-way, you need a Right-of-Way Use Permit. To operate in a city park, you need authorization from the Parks Department or a special-event permit (e.g., a River District Alliance event). The city cannot block you from operating in private commercial parking lots based on distance from a restaurant.
