Do I have to live on-site to rent out my ADU in Grand Rapids?

No. Following the 2023 reforms to Chapter 61 Article 5 (Zoning Ordinance), Grand Rapids does not require owner-occupancy as a condition of operating an accessory dwelling unit. The property owner may rent both the principal dwelling and the ADU to non-owner tenants. Each non-owner-occupied unit must obtain a rental certificate under Chapter 173 (Rental Property Maintenance and Inspection) and pass periodic Code Compliance inspections. Private subdivision CC&Rs may separately impose owner-occupancy rules.

Does Michigan preempt city owner-occupancy rules?

Michigan has not enacted a statewide ADU enabling statute or a statewide preemption of municipal owner-occupancy rules. Zoning authority rests with the municipality under the Michigan Zoning Enabling Act (MCL 125.3101 et seq.). Bills have been introduced to enable ADUs statewide but none has passed. Because Grand Rapids has chosen not to require owner-occupancy, no preemption question arises here. Other Michigan cities that retain owner-occupancy rules continue to enforce them under their own zoning authority.
