Can the pool's own wall act as the safety barrier?

Yes, if the outer wall of the above-ground pool is at least 48 inches above the surrounding grade. Under Hawaii Building Code Β§3109.4 (adopted by ROH Chapter 16), when the pool wall serves as the barrier, the vertical gap between the top of the pool wall and the bottom of any deck-mounted barrier cannot exceed 4 inches, and openings in the pool wall cannot pass a 4-inch-diameter sphere.

What do I have to do with the ladder when the pool is not in use?

If the above-ground pool's wall is the barrier, the ladder or steps must either be capable of being secured, locked, or removed when the pool is not in use, or must be surrounded by a separate code-compliant 48-inch fence. When the ladder is removed or secured, any opening it leaves cannot allow a 4-inch sphere to pass through.

Are above-ground pool rules different for short-term rental properties?

The barrier standards under ROH Chapter 16 apply identically, but rental and shared pools also fall under Hawaii Department of Health rules in HAR Title 11, Chapter 10 (Public Swimming Pools).
