Fencing Requirements: Moss Point vs Ocean Springs

Mississippi adopted the International Residential Code statewide under Miss. Code Ann. § 17-25-21 (Mississippi Building Code Council). Residential swimming pools in Moss Point must comply with IRC Appendix AG, Section AG105 Barrier Requirements: a barrier at least 48 inches high measured from the outside, openings that do not allow a 4-inch sphere to pass, and self-closing, self-latching gates opening outward from the pool. The William Lee Montjoy Pool Safety Act (Miss. Code Ann. Ch. 45-43) imposes more detailed enclosure and gate rules but applies to public, semi-public, hotel, motel, apartment, and HOA pools, not single-family residential pools.

Ocean Springs enforces residential pool barrier rules through the 2018 International Residential Code (IRC), adopted by the Mayor and Board of Aldermen on August 21, 2018. Under IRC Appendix G / Section R326 and the 2015 International Swimming Pool and Spa Code, pool barriers must be at least 48 inches high with no openings allowing a 4-inch sphere to pass. Gates must open outward, be self-closing, and self-latching with the latch at least 54 inches above grade. Mississippi adopts these codes through Miss. Code Ann. § 21-19-25 (municipal code adoption authority).
