How do parkway planting rules compare between Tulare, CA and Visalia, CA?

Tulare, CA

Tulare County

Some Restrictions

Tulare Municipal Code Ch 8.32 governs street trees in the parkway strip (between sidewalk and curb). Property owners are responsible for maintaining adjacent parkway trees, and ALL damage caused by a parkway tree (to the owner's property, sewer laterals, or water service lines) is the property owner's responsibility. New plantings must come from the City Street Tree Master Plan species list, be installed from 15-gallon containers, staked to city standards, and spaced generally 35 feet apart. Permits are required to plant, prune (beyond ISA standards), or remove parkway trees.

Tulare FAQ

The City planted the tree — why am I responsible for it?

Tulare Municipal Code § 8.32.060 places maintenance and damage responsibility on the abutting property owner regardless of who originally planted the tree. The parkway strip is public right-of-way but the adjacent owner has the statutory duty to maintain it. If a parkway tree damages your sewer lateral, you pay the repair.

Can I plant whatever tree I want in the parkway?

No. New parkway plantings must come from the City Street Tree Master Plan and be approved by Parks and Recreation. Request the current approved species list before purchasing. Unapproved species can be ordered removed at your expense.

Do I need a permit to trim parkway tree branches that overhang my driveway?

Minor trimming for clearance is generally allowed without a formal permit, but it must follow International Society of Arboriculture (I.S.A.) pruning standards (no topping, no flush cuts). For substantial pruning or any work on a heritage parkway tree, contact Parks first. Pruning that damages the tree can lead to enforcement and replacement cost recovery.
