Construction in the SFHA without a Floodplain Development Permit, or failure to elevate to the BFE plus required freeboard, violates the county Floodplain Management Ordinance and triggers NFIP § 1316 sanctions — FEMA may deny flood insurance for the noncompliant structure. Under SDCL 11-2-35 violations are a Class 2 misdemeanor and the county may seek injunctive relief and abatement.
