Standard NFIP-model provisions require a development permit for new construction, substantial improvement, or substantial damage repair within a Special Flood Hazard Area; elevation of the lowest floor at or above the BFE plus freeboard; V-zone construction on piles or columns with breakaway walls below the BFE; and application of FEMA's 50-percent substantial-improvement rule (44 CFR 59.1, 44 CFR 60.3). Floodplain administration is handled by the Community Development Department (228-475-0300), which issues elevation certificates and floodplain development permits.
Construction, substantial improvement, or substantial-damage repair in a Special Flood Hazard Area without a floodplain development permit, or below the required Base Flood Elevation plus 1-foot freeboard, violates Moss Point's Flood Damage Prevention Ordinance and the NFIP minimum standards in 44 CFR 60.3. The City may issue stop-work orders, deny Certificates of Occupancy, and require post-construction elevation or removal. Continued non-compliance can jeopardize the City's NFIP standing, and structures built in violation may be ineligible for federal flood insurance. Property owners who exceed the FEMA 50-percent threshold without elevating may be denied permits for further improvements.
