Berkeley Municipal Code Title 19 (Building Code) Chapter 19.28 adopts the California Building Code Appendix J requiring grading permits for excavation or fill exceeding 50 cubic yards, cuts or fills deeper than 3 feet, or work on slopes steeper than 3:1. Applications require site plans, cross-sections, and a soils report for projects in Hillside Overlay areas or on slopes over 20 percent. The Hayward Fault and Alquist-Priolo Earthquake Fault Zone run through Berkeley requiring fault investigation for habitable structures within the zone. Drainage must be directed to approved disposal points without creating nuisance to neighbors per state Civil Code. Erosion and sediment control is required during construction (see separate subcategory). Retaining walls over 4 feet measured from bottom of footing require engineered design and building permit. Work is prohibited in the rainy season without approved winterization.
