Security fences for pools or tennis courts may be up to 10 feet high if set back one foot from the property line for each foot they exceed 6 feet and the use is in a rear yard. Sec. 5-1.7 additionally requires all walls and fences to be properly maintained, with missing or damaged parts replaced and surfaces repainted or repaired.
A non-compliant pool barrier or unmaintained fence is a code violation. The county can require correction, order self-latching gates or a conforming barrier, and issue fines through code enforcement.
