Sutter County restricts fences near street corners and rights-of-way: on corner lots nothing over 30 inches tall may stand in the clear vision triangle, all walls and fences must preserve traffic sight distance, and gates on agricultural front fences must be set back at least 20 feet from any future road right-of-way.
Under the development standards of the Sutter County Zoning Code (Sections 1500-05-040, 1500-06-040, and 1500-07-040), on a corner lot no fence, wall, hedge, sign, shrubbery, mound of earth, or other visual obstruction over 30 inches above curb elevation may be erected or allowed to grow within the clear vision triangle. Section 1500-27-020 defines the clear vision triangle as the triangular area formed by points measured 25 feet along the front and 100 feet along the side of the property from the back of curb; the Director may require a larger triangle to avoid traffic hazards. All walls and fences must be designed and built so they do not restrict vehicular traffic sight distance as determined by the Director, and the County may require an engineering analysis at the applicant's expense for taller front-setback fences in the ER and RAN districts. In the Agricultural (AG) district, solid or open front fences must sit outside any future maximum right-of-way identified in the Sutter County General Plan, and any gate through such a fence must be set back at least 20 feet from that future right-of-way. Fences may not conflict with established rights-of-way or public utility easements.
A fence that blocks the clear vision triangle or restricts traffic sight distance violates the Zoning Code and may be declared a public nuisance and abated under Section 1500-26-040. Willful violations are a misdemeanor or infraction under Section 1500-26-060, and administrative penalties may be assessed under Chapter 87 of the Sutter County Ordinance Code.
