Idaho Code section 35-103 establishes a statewide rule for partition fences between adjoining properties. When one owner needs a partition fence to protect their interests, the neighbor must, after written notice, build half of the fence on or near the property line. If the notified party fails to complete their half within six months, the requesting owner may build the entire fence and collect half of the cost from the neighbor through legal action, including a lien on the neighbor's land. Section 35-104 covers maintenance and repair obligations, and section 35-105 addresses removal of partition fences.
Failure to contribute creates a civil debt. The party building the fence may sue for half the cost and place a lien on the non-contributing neighbor's land.
