Florida common law and the Indiantown LDR Sec. 3-4.7 govern boundary fences between neighbors. There is no statutory cost-sharing requirement; fence ownership and maintenance default to the party who built and owns the fence.
Florida law does not impose a 'good neighbor' cost-sharing duty unless agreed in writing. Under the LDR, fence permits require a sealed survey identifying property lines so the fence is on the permittee's side. Spite fences (built solely to annoy a neighbor) can be subject to nuisance suits under common law. The 'finished side' of a fence (rails inside) is a common courtesy but is not required by Indiantown's code. Disputes over encroachment must be resolved through the court system; the Village does not adjudicate civil property disputes.
