Nebraska has no residential cost-sharing fence statute. NRS Β§34-102 covers partition fences for agricultural land. Boundary disputes resolved through common law.
Nebraska does not have a residential cost-sharing fence statute. Each property owner is responsible for their own fence. NRS Β§34-102 and following sections (partition fence law) apply only to agricultural and rural land requiring landowners to maintain partition fences. For residential properties, boundary fence disputes are resolved through common law and civil court. Spite fences (built maliciously to annoy neighbors) may be actionable as a nuisance. Property surveys are recommended before building near boundary lines.
Civil remedy: lawsuits for encroachment or nuisance. Small claims court for disputes under $3,600. Spite fence: injunction plus damages.
