Texas law imposes no duty to split the cost of a division fence, unlike California. In unincorporated Guadalupe County a shared boundary fence is a private matter: neither owner can compel the other to build, repair, or pay half. Cost-sharing happens only by a voluntary written agreement. A licensed survey establishes the true property line before a fence goes up, preventing encroachment disputes. Boundary and encroachment disagreements are resolved in civil court, not by the county. A spite fence built purely to annoy a neighbor may be challenged as a common-law nuisance.
The county does not mediate fence disputes. A neighbor who builds over the line or damages your fence is pursued through a civil suit; a court can order an encroaching fence removed.
