Backyard recreational and ceremonial fires are allowed in Rio Rancho only if kept in a spark-arrested fire pit and continually monitored, with extinguishing equipment on hand. Burning trash, leaves, or green vegetation is illegal citywide, and a Fire Marshal burn ban can restrict open flame during high fire danger.
Rio Rancho's backyard-fire rules flow from Chapter 93 (Fire Code and Burning Regulations), which adopts New Mexico's minimum fire codes (the 2021 IFC, 10.25 NMAC). Recreational and ceremonial fires are permitted when contained in a spark-arrested fire pit and continually attended. You may not burn leaves, green weeds, nuisance vegetation, trash, or garbage in your yard - those are prohibited citywide because of the smoke they create. Only dry tumbleweeds may be burned, and only under the city's burn-day rules (designated days, 10 a.m.-3 p.m., piles under 3x3x3 ft, at least 25 ft from structures, out by 3:30 p.m.). Whether you have a recreational fire or a tumbleweed pile, fire-extinguishing equipment (garden hose, fire extinguisher, or water truck) must be on site and the fire must be constantly attended until completely extinguished. No open fires or fireworks are allowed in the Rio Grande Bosque at any time. During elevated fire danger, Rio Rancho Fire and Rescue can implement a citywide burn ban that prohibits outdoor open flame such as weed burning, while still allowing recreational fires in spark-arrested pits that are continually monitored. Always confirm the current burn status on the burn line, (505) 891-7268.
Leaving a backyard fire unattended, burning prohibited materials, or violating a burn ban violates Chapter 93 and can be punished by a fine of up to $500 and/or up to 90 days in jail. Each day or incident can be treated as a separate offense.
