Public Safety Article Section 5-133 establishes that the regulated firearm laws of Maryland supersede any local firearm laws or ordinances except those concerning the discharge of firearms. Counties, municipalities, and Baltimore City retain authority to regulate where firearms may be discharged but cannot impose additional licensing, registration, or possession rules. Local governments also retain limited zoning authority over firearm dealers. The State Police administer permits, background checks, and the Handgun Qualification License program statewide.
Violating state firearm transfer or possession laws is generally a misdemeanor or felony depending on the offense, with penalties up to several years imprisonment.
