West Des Moines' Code of Ordinances (codelibrary.amlegal.com/codes/westdesmoinesia) is administered by the City Clerk and Community Compliance. Garage-sale signs are governed under the city's Sign Code: signs must be on private property with the owner's permission, must not be in the public right-of-way (including parkways, utility poles, and street-sign posts), and must be removed within 24 hours after the sale ends. Sales must be conducted by the resident at the residence and must be limited to household personal property (not new merchandise). The frequency limit and any required reporting are administered by Community Compliance (515-222-3480). Operating recurring sales of new merchandise converts the activity to retail and requires an Iowa Retail Sales Tax Permit plus a West Des Moines business license. Iowa Code ยง 423.2 exempts occasional 'casual sales' from the state retail sales tax permit.
Exceeding the annual garage-sale limit, conducting commercial retail under the guise of a garage sale, or placing signs in the public right-of-way is a city ordinance violation subject to fines under the West Des Moines general penalty schedule. Signs in the right-of-way are removed by Public Services.
