Under ORS 329A.440, a family child care home, a dwelling caring for not more than 16 children and registered or certified by the state, is a permitted residential use in all areas zoned for residential or commercial purposes, including single-family zones. A local government may not impose land use regulations, special fees, or conditions more restrictive than those on other residential dwellings in the same zone. So Clackamas County cannot zone out a properly registered home daycare. State certification/registration through Oregon's Department of Early Learning and Care is still required, along with any building-code compliance.
A local land use regulation that unlawfully restricts a family child care home is preempted by ORS 329A.440; state licensing violations are enforced by the Department of Early Learning and Care.
