Most boroughs and townships require zoning certificates or home occupation permits with fees $25-$150. Pennsylvania has no state-level home business preemption. Each of the 130 municipalities in Allegheny County adopts its own zoning ordinance governing home occupations. Pittsburgh (Zoning Code §911.04.A.20) allows home occupations by-right with restrictions. Typical requirements across county: occupation conducted by resident only, no more than 25% of dwelling floor area used, no signage larger than 2 sq ft, no commercial vehicles stored on-site, no manufacturing or noxious activities. Cottage food operators must also register with PA Department of Agriculture under Act 106 of 2022. Business privilege tax registration required with local tax collector (typically Jordan Tax Service or Keystone Collections in Allegheny County).
Operating without required permit: $100-$500 first offense, up to $1,000 per day for continued violation under MPC §10617.2. Zoning enforcement by municipal zoning officer.
