All home occupations in Prince George's County require a use and occupancy permit from DPIE under Zoning Ordinance Section 27-5203(b)(6)(A). The permit confirms the home business meets the accessory-use standards - indoor operation, the 25 percent floor-area limit, and the two-nonresident-employee cap - before it may operate.
Section 27-5203(b)(6)(A) states that all home occupations require a use and occupancy permit, cross-referencing Section 27-3608. The permit comes from DPIE, which verifies compliance with the Section 27-5203(b)(6) standards: the business is inside the dwelling; occupies no more than 25 percent of the floor area or 5,000 square feet; the operator is a full-time resident; there are no more than two nonresident employees; and there is no outdoor storage, non-incidental retail, or off-premises nuisance. The ordinance also limits home-occupation vehicles to two. Intensive uses such as a home dog daycare must meet added standards (minimum one-acre lot, capped dog count). A use that cannot meet these standards is not eligible for a home-occupation permit.
Operating without the required use and occupancy permit, or outside its terms, is a zoning violation. DPIE can issue civil citations, order the business to cease, and pursue escalating fines. A use exceeding the standards must instead seek commercial approval.
