A zoning permit from the Director of Inspections is required for a home occupation in the unincorporated county. The permit is granted only when all UDO conditions are met and is revoked if the home occupation ever fails to meet them.
Under UDO Section B.2-6.4(D)(2), the Director of Inspections issues a zoning permit for a home occupation only after determining that all prescribed conditions are met. Zoning permits cover listed service occupations such as offices and studios of accountants, architects, attorneys, artists, physicians, and teachers (up to three pupils at a time), plus dressmaking, tailoring, home cooking, and telephone/mail services. Only family members residing in the dwelling plus one additional employee may work there. Construction contracting and motor-vehicle repair require a Special Use Permit from the Board of Adjustment in rural GMAs 4 and 5. The permit is revoked whenever the home occupation fails to meet the requirements.
The zoning permit is automatically revoked upon a finding that the home occupation fails at any time to meet the UDO requirements; continued operation is then a zoning violation subject to enforcement.
