Home occupation permits are issued by your borough or township, not Montgomery County. Under the PA Municipalities Planning Code, municipal zoning ordinances decide whether a home occupation needs a zoning permit, use registration, or a special exception.
Montgomery County does not issue home-occupation permits. Each of its 62 municipalities regulates home occupations through its own zoning ordinance under the Pennsylvania Municipalities Planning Code (53 P.S. 10101 et seq.). Depending on the ordinance, you may need a zoning/use permit, a home-occupation registration, or approval by special exception from the zoning hearing board, with conditions on employees, customer visits, deliveries, and signage. Some businesses also need a state trade license and a local business privilege or mercantile registration. Always start with your municipal zoning officer to learn which approval applies.
Operating without a required home-occupation approval is a municipal zoning violation. Enforcement includes cease-and-desist orders and MPC civil penalties up to $500 per day of a continuing violation via the district court.
