A home occupation in unincorporated St. Clair County requires a permit obtained through application to and a hearing before the Zoning Board of Appeals. Pure telecommuting needs no permit. The business may not operate before 8 a.m. or after 10 p.m.
Section 40-5-9(B) of the County Zoning Ordinance states no home occupation is permitted without prior application to, and a hearing by, the Zoning Board of Appeals. The applicant must supply all maps, plans, and information the Board requires, and the hearing follows the Board's rules. Operating hours open to the public are limited to 8:00 a.m. through 10:00 p.m., off-street parking must be adequate, and the use must comply with any recorded covenants. Telecommuting β working from home via a computer connected to a central office β is exempt and needs no permit. Municipal residents apply to their own city or village, not the county.
Running a home occupation without Zoning Board of Appeals approval, or outside the 8 a.m.β10 p.m. public hours, violates the ordinance and can be enforced by the Zoning Administrator.
