NYC does not issue a standalone Queens home-occupation permit. Operators self-certify ZR 12-10 compliance and secure any DCWP industry license and an NYS sales tax Certificate of Authority.
Queens operators often ask where to apply for a home business permit and are surprised to learn that no single permit exists at the city level. The NYC Zoning Resolution simply treats home occupations as a permitted accessory use in residence districts, so compliance is self-executing as long as the activity meets the 25 percent floor-area limit, 500 square foot cap, one non-resident employee, no exterior alterations, and limited signage rules. What operators do need is a collection of occupation-specific approvals. First, the NYC Department of Consumer and Worker Protection (DCWP) requires a general business license or industry-specific license for a long list of services ranging from tax preparer and process server to home improvement contractor. Second, the NYS Department of Taxation and Finance requires a Certificate of Authority for anyone selling tangible goods or taxable services. Third, professionals regulated at the state level (attorneys, architects, engineers, physicians, nurses, licensed therapists) carry their own state license that satisfies the professional-activity rules under ZR 12-10. If any construction, plumbing, or electrical work is needed to convert a portion of the home for the business, a Department of Buildings permit through a registered design professional is required. Operators in coop or condo buildings also need to check the proprietary lease or bylaws, many of which prohibit home businesses entirely or require board approval.
