Federal law makes E-Verify voluntary for most private employers, and Colorado has not enacted a statewide mandate. Colorado repealed its prior state-specific employment verification affidavit in 2016, leaving the federal Form I-9 as the standard. Aurora has not adopted any local E-Verify ordinance. Federal contractors that fall under FAR 52.222-54 must enroll, which captures many Lockheed Martin and Buckley Space Force Base subcontractors operating in Aurora. Public works funded by federal grants may also trigger enrollment. Employers cannot use E-Verify selectively against certain workers; misuse can support discrimination claims under federal law.
Discriminatory use of E-Verify, failure to follow Form I-9 retention rules, or noncompliance with federal contractor verification requirements can result in DOJ enforcement, fines, and contract debarment.
