IC 22-5-1.7 requires every state agency and political subdivision to enroll in the federal E-Verify program and to use it to verify the work eligibility of newly hired employees. Public contracts must include a provision requiring contractors to enroll in and use E-Verify and to certify that they do not knowingly employ unauthorized aliens. A contractor that fails to comply or knowingly employs an unauthorized alien may have its contract terminated by the public agency. The statute does not impose a universal private-employer mandate, but it applies broadly across state and local government contracting and supersedes any conflicting local rule on the subject.
Public contractors that violate E-Verify requirements may face contract termination under IC 22-5-1.7-11 and ineligibility for future public contracts.
